Commercial Risk, Contract Law and Contract Drafting

Course overview

No engineer can ignore the law regulating contractual relationships with clients, suppliers and partner organisations. Technical risks may be under control but a project can still expose an organisation to commercial or contract risk. Drafting appropriate engineering contracts is a skill that will minimize commercial and legal liabilities. This two-day training has been designed specifically to make Engineers think in a commercial and legal way when they manage projects or prepare bids.

What you will learn:

  • See your role in a commercial context
  • Understand the special features of engineering sector contracts
  • Use standard contract forms including MF/1
  • Identify the benefits of time spent at the front end, pre-contract award, on drafting and negotiating a solid contract in order to reduce problems later, during contract management stage
  • Appreciate strict liability for delay and excusable delay and the risk of damages
  • Anticipate, identify and manage potential risks, both pre- and post-contract award
  • Understand the relevance of the Sale of Goods Act 1979, The Unfair Contract Terms Act 1977, and the Supply of Goods and Services Act 1982 to all engineering projects
