An arbitrator, or a panel of arbitrators, or an Arbitrator Appointing Body may be named in the contract. If that is the case, the party seeking arbitration should follow the procedure laid down in the contract. If there is no contractual procedure (known as the Arbitration Agreement), the parties are free to agree a suitable arbitrator, or, in the absence of such agreement, to approach any professional body that is recognised as an appointing body for arbitrators.
The IMechE is such a body, and we will be pleased to assist with the appointment of an arbitrator. We maintain a list of Chartered Arbitrators, all of whom are Chartered Engineers who have obtained further qualifications and experience in settlement of disputes by arbitration.
